Terms of Service

Please read these Terms of Service ("Terms") carefully before using Project Tracker operated by Project Tracker. By accessing or using the Service, you agree to be bound by these Terms.

1. Description of Service

Project Tracker is a cloud-based project and document management platform for accounting, tax, and business compliance professionals and their clients. The Service enables users to track projects, manage documents, communicate with service providers, and submit filings to regulatory bodies including SARS and CIPC.

2. User Accounts

• You must provide accurate and complete information when creating an account
• You are responsible for maintaining the confidentiality of your login credentials
• You must notify us immediately of any unauthorised use of your account
• Accounts may not be transferred or sold to another party without prior written consent

3. Acceptable Use

You agree not to use the Service to:

• Upload, transmit, or store any unlawful, harmful, fraudulent, or misleading content
• Impersonate any person or misrepresent your affiliation with a person or entity
• Attempt unauthorised access to any part of the Service or its related systems
• Introduce malware, viruses, or any other malicious code
• Violate any applicable South African or international law or regulation

4. Document Uploads and Data Accuracy

You are solely responsible for the accuracy, completeness, and legality of all documents and data you upload. Penalties, interest, or other consequences arising from inaccurate or incomplete submissions to regulatory bodies remain the responsibility of the account holder.

5. WhatsApp Communications

By providing a WhatsApp number, you consent to receiving service-related notifications via the Meta WhatsApp Business API. You may opt out at any time by contacting sales@projecttracker.co.za or replying STOP to any message. Standard messaging rates from your mobile provider may apply.

6. Intellectual Property

The Service, including its design, code, and content, is the property of Project Tracker and is protected by intellectual property law. Documents and data you upload remain your property. By uploading content, you grant us a limited licence to store and process it solely to deliver the Service.

7. Confidentiality

We treat all client information as strictly confidential. Information is only shared with third parties as necessary to deliver services or as required by law. Our staff are bound by confidentiality obligations.

8. Service Availability

We aim to maintain high availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance or circumstances beyond our control. We will endeavour to provide advance notice of planned downtime where possible.

9. Limitation of Liability

To the maximum extent permitted by South African law, Project Tracker shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Service. Our total liability for any claim shall not exceed the amount paid by you in the twelve months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless Project Tracker, its directors, employees, and agents from any claims, damages, or expenses arising from your violation of these Terms or misuse of the Service.

11. Termination

Either party may terminate access at any time. We reserve the right to suspend or terminate accounts that violate these Terms or pose a security risk. Data retention obligations under our Privacy Policy continue to apply after termination.

12. Fees, Payments and Refunds

Fees for professional services and monthly retainers are agreed with each client at the time of engagement and are billed through the Service. Payments made through the Service are for professional services rendered and monthly retainer packages.

If a payment was made in error, was duplicated, or a paid service cannot be delivered, contact us at sales@projecttracker.co.za or on WhatsApp at 083 608 7367. We will investigate and resolve the matter under the terms of your engagement, including a refund where one is due. Refunds, where approved, are processed to the original payment method.

13. Governing Law

These Terms are governed by the laws of the Republic of South Africa. Any disputes shall be subject to the exclusive jurisdiction of the South African courts.

14. Changes to Terms

We may modify these Terms at any time. Changes will be posted on this page with an updated revision date. Continued use after the effective date constitutes your acceptance.
